Terms and conditions of sale in the Online Store operated by the Seller at: https://szaldlaplastykow.pl/

 

The Seller is Szał dla Plastyków, a limited liability company, with its registered office in Nowa Wieś Szlachecka, at 1 Lisiecka Street (32-060 Nowa Wieś Szlachecka), entered into the register of entrepreneurs maintained by the District Court for Kraków-Śródmieście in Kraków, 12th Commercial Division of the National Court Register under the KRS number 0001103537, Tax Identification Number (NIP) 9442288563, National Business Registry Number (REGON) 528543884

 

§ 1 General provisions

 

These Terms and Conditions define the rules for the sale of Goods offered by the Szał dla Plastyków sp. z o. o. Store in Nowa Wieś Szlachecka. Purchase of Goods is subject to the terms and conditions set forth in these Terms and Conditions.

Sales in the online store are conducted by Szał dla Plastyków sp. z o. o. based in Nowa Wieś Szlachecka.

These Regulations may be copied in whole or in part onto any digital medium or printed before placing an order.

The cost of telecommunications calls to the Seller is in accordance with the tariff applied by the telecommunications operator whose services the Customer uses. The Customer is responsible for the cost of the call.

§ 2 Definitions

 

The names used in the Regulations mean:

Seller: Szał dla plastikowscy Limited liability company, with its registered office in Nowa Wieś Szlachecka, at 1 Lisiecka Street (32-060 Nowa Wieś Szlachecka), entered into the register of entrepreneurs maintained by the District Court for Kraków-Śródmieście in Kraków, 12th Commercial Division of the National Court Register under the KRS number 0001103537, Tax Identification Number (NIP) 9442288563 ;

Store, Online Store: A sales platform operated electronically by the Seller, available at a specific URL ( https://szaldlaplastykow.pl/) , enabling Customers to browse the offer, place orders, and complete transactions online. The Online Store operates pursuant to the Terms and Conditions, providing Customers with convenient access to Goods and Services and providing service in accordance with applicable law;

Consumer: a natural person who performs a legal act with the company that is not directly related to its business or professional activity;

Customer: Consumer, as well as any other natural person, legal person or organizational unit without legal personality making purchases in the Store;

Goods: paints, cardboard, brushes, easels and other movable items offered in the store,

Courier: carrier to whom the Seller commissions the delivery of the purchased Goods;

Newsletter: An electronic form of marketing communication sent by the Seller to the email address provided by the Customer, containing information about new products, promotions, events, and special offers related to the Online Store. Subscription to the Newsletter requires the Customer's consent, which may be withdrawn at any time;

Complaint: a claim submitted by the Customer to the Seller regarding the non-conformity of the Goods with the contract or other irregularities related to the execution of the order, aimed at bringing the Goods into conformity with the contract, reducing the price or withdrawing from the contract, in accordance with the provisions of law and the provisions of the Regulations.

 

§ 3 Information about the Goods

 

Information about the Store's offer and available Goods is available on the website of the online Store www.szaldlaplastykow.pl and is available in the Store by calling 789 822 322. It constitutes an invitation to conclude a contract.

within the meaning of Article 71 of the Civil Code.

All prices of Goods posted on the website of the Online Store www.szaldlaplastykow.pl include VAT and do not include delivery costs.

The Seller reserves the right to make ongoing changes to the prices of Goods and to conduct and cancel all types of promotional campaigns and sales. This right does not affect orders placed before the effective date of the price change, terms of the promotional campaign, or sales.

The prices quoted are binding at the time of placing the order and cannot be changed after it has been placed.

In the event of an obvious error in the price of the Goods, in particular a price that significantly deviates from their market value (e.g., resulting from a system error), the Seller reserves the right to cancel the order after informing the Customer. Systemic pricing errors do not constitute an offer within the meaning of the Civil Code. The Seller hereby informs that the colors of the color samples posted on the online store website www.szaldlaplastykow.pl may vary due to monitor parameters. A difference in the color of the actual product compared to the color sample available in the store does not constitute grounds for complaint.

 

§ 4 Receiving and fulfilling orders

 

Orders from customers are accepted via the website www.szaldlaplastykow.pl without interruption.

The basic condition for the execution of the order is the correct completion of the order form available on the website of the Online Store www.szaldlaplastykow.pl.

The order will be fulfilled provided the Goods are available in the Seller's warehouse. A zero price for a Good means that it is not currently available in the Seller's warehouse. The Goods will not be shipped if the price is due to a system error and does not constitute an actual commercial offer. In the event that some of the Goods included in the order are unavailable, the Customer will be informed of the order status and will decide how to fulfill it (partial fulfillment or cancellation of the entire order). This also applies to Goods currently unavailable on the Store's website.

All changes and cancellations of orders require confirmation by the Seller.

A limited number of Goods are designated for promotional sales and clearance sales, and orders will be processed in the order in which they are received until stocks for this type of sale are exhausted. Orders paid correctly via the quick payment gateway and those paid upon delivery (cash on delivery) will be processed immediately. Orders paid by bank transfer will be processed after payment is credited to the Company's bank account:

The Customer may make changes to the order until the sales document (invoice) is issued, after prior confirmation of the possibility of changes by the Seller. The Customer may withdraw the entire order until it is shipped. These changes can be made by contacting the Store via email at [email protected]. The Store responds to requests within 2 business days.

 

§ 5 Orders in the Online Store

 

An order is considered to be effectively placed when the Customer has provided the correct data necessary to complete the order in the Order Form, including the correct contact details: the exact address to which the Goods are to be sent, the telephone number and the e-mail address.

To purchase Goods offered by the online store, the Customer must place an order for the designated Goods and confirm it by clicking the "Place Order" button. After placing a valid order, the Customer will receive an order confirmation via email.

If the Customer fails to provide complete information or the information contains errors that prevent the order from being fulfilled, the Seller will contact the Customer to provide the information. If contact with the Customer is impossible, the Seller reserves the right to cancel the order.

Orders can also be placed as a registered user. Registration and login are consistent with the Privacy Policy. As a result of registration, a password is assigned to the login provided by the customer. The customer completes their initial registration by:

completing the registration form and accepting the terms and conditions contained therein,

Confirm your registration by clicking on the link in the registration email sent by the Online Store to the email address provided by the customer in the registration form. Note: the email may end up in your SPAM folder. Any subsequent purchases in the Online Store must be logged in by entering your correct login (email address) and the corresponding password.

Online payments are processed through payment operators available in the Online Store, in particular Autopay SA and Paynow.

§ 6 Payment for purchased goods

 

Payment for the purchased Goods and shipping costs is made: cash on delivery ( upon receipt of the Goods) , prepayment – by bank transfer to the Seller's bank account provided in the order confirmation, or through electronic payment systems available in the Online Store, particularly Autopay and Paynow. For bank transfers to the store's account, please include the order number in the payment reference. The date of payment is the date the bank credits the Seller's bank account (records the payment).

If the Customer is a VAT payer and wishes to receive a VAT invoice, they should provide the Seller with all the information necessary to issue the invoice when placing the order. By default, the invoice is issued to the Customer's details provided in the Order Form.

 

§ 7 Discount program for regular customers

 

The online store may operate a customer loyalty program. Detailed program rules are set forth in separate terms and conditions available on the website.

 

§ 8 Delivery of purchased Goods

 

The delivery of purchased Goods will be made via carriers cooperating with the Seller. The Goods will be shipped within the timeframe described for the product. If the dimensions of the shipment exceed 0.9 meters, delivery will be made exclusively via courier. Shipments within Poland are delivered according to the delivery times used by carriers cooperating with the Seller. Order processing time is counted from the moment of receiving positive payment authorization.

For a one-time prepaid purchase of at least PLN 199, the Store covers the shipping costs, except for deliveries shipped internationally and deliveries of Goods on pallets. In these cases, shipping costs are agreed individually with the Customer, taking into account the size of the shipment, weight, and country of delivery.

After collecting the shipment from the Seller, the Courier will send the Customer an email or text message confirming the shipment of the ordered Goods, along with the tracking number. The Customer should check the condition of the shipment in the Courier's presence. If damage is detected, it is recommended to take a photo of the damaged Goods, complete a damage report, and forward it to the Courier and the Seller. Then, contact the Seller to request a replacement.


The delivery fee for the purchased Goods is calculated in accordance with the current delivery price list in force in the Online Store, determined on the basis of the tariffs of carriers cooperating with the Seller, including VAT.

The final shipping cost is visible in the shopping cart before placing the order (link to shipping costs).

 

§ 9 Consumer Rights

 

Pursuant to the Act of 30 May 2014 on Consumer Rights (Journal of Laws, as amended), the Customer who is a consumer within the meaning of Article 22¹ of the Civil Code has the right to withdraw from a distance contract without giving any reason within 14 days from the date of receipt of the Goods.

To meet the deadline, it is sufficient to send a declaration of withdrawal from the contract before its expiry.

The consumer may use the model withdrawal form or submit a declaration of withdrawal from the contract via the website www.szaldlaplastykow.pl (link to the withdrawal form).

The Seller shall immediately send the Consumer electronically confirmation of receipt of the declaration of withdrawal from the contract.

The Seller shall refund the payments received from the Consumer, including the costs of delivery of the Goods (except for additional costs resulting from the Consumer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller), no later than within 14 days from the date of receipt of the declaration of withdrawal from the contract.

Refunds will be made using the same payment method used by the Consumer, unless the Consumer expressly consents to a different refund method that does not incur any costs. For refunds made through electronic payment providers (e.g., Paynow), the refund is initiated by the Seller immediately. The time it takes for the funds to be credited to the Customer's account or card depends on the operating policies of the payment provider and the Customer's bank. In the case of Paynow, the refund process can take up to 120 hours from the time the Seller requests the refund. For transactions made with a payment card, the refund is made to the bank account associated with the payment card used for payment. If a refund using the original payment method is not possible, the refund will be made to the bank account specified by the Consumer.

The Seller may withhold the reimbursement of payments received from the Consumer until the Goods are received back or the Consumer provides proof of having sent them back, whichever occurs first.

The Consumer is obligated to return the Goods to the Seller immediately, but no later than 14 days from the date of withdrawal. To meet the deadline, it is sufficient to return the Goods before its expiry.

The consumer bears the direct costs of returning the Goods.

If the Consumer has chosen a method of delivery of the Goods other than the cheapest standard delivery method offered by the Seller, the Seller is not obliged to reimburse the Consumer for the additional costs incurred by him.

The Consumer is liable for any diminished value of the Goods resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the Goods. In the case of consumable products or those whose properties become apparent during use (in particular paints, markers, inks, brushes, art media, artistic paper, and other artistic materials), opening the packaging, particularly by removing security features, tearing or removing sheets, or using the product may result in a loss of commercial value. In such a case, the Seller may reduce the refund accordingly, and if the Goods are not suitable for resale as new, the reduction may be up to 100% of the value of the Goods. The Seller assesses the degree of diminished value of the Goods based on the condition of the returned Goods and the possibility of their resale as new.

In the event of a return of the entire order, the Consumer is also obliged to return all free items received with the order, resulting from a promotion or from the good will of the Seller.

Regardless of the statutory right to withdraw from the contract within 14 days, the Seller allows the return of the Goods within 60 days from the date of receipt of the Goods.

In the event of a return made after the statutory period of 14 days, the refund will be made in the form of a Madness for Artists Gift Card with the value of the returned Goods.

A Gift Card issued as part of a refund is valid for 12 months from the date of issue.

Returns within the extended period are only possible if the Goods do not show any signs of use, are new, have the factory packaging and are in a condition that allows them to be resold.

The right to withdraw from the contract does not apply to the Consumer in the cases specified in Article 38 of the Consumer Rights Act, in particular when the subject of sale is a Good delivered in a sealed package which cannot be returned after opening due to health protection or hygiene reasons.

In the case of consumable products or those whose properties become apparent during use (in particular paints, markers, inks, painting media, artistic papers and other artistic materials), starting to use the product may result in the loss of the possibility of reselling it as new, which may constitute grounds for refusing to accept a return within the extended return period (up to 60 days).

§ 10 Complaints

 

The Seller is obligated to deliver the Goods to the Customer in accordance with the contract. If the Goods are found to be inconsistent with the contract, the Customer may file a complaint in accordance with the provisions of the Consumer Rights Act.

The Customer shall notify the Seller of any non-conformity of the Goods with the contract in writing or electronically (via email to [email protected] or by sending a message for a specific order in the order history and details area of the customer panel). The Customer shall make the Goods subject to the complaint available to the Seller, and if it is necessary to return or collect them, the Seller shall bear the associated costs, in accordance with applicable law.

In connection with a submitted complaint, the Customer may request repair or replacement of the Goods. In cases provided for in the Consumer Rights Act, the Customer may also submit a declaration of price reduction or withdrawal from the contract.

The Seller is obligated to acknowledge receipt of the complaint electronically by sending a confirmation to the Customer. The Seller is obligated to respond to the complaint within 14 days of its receipt and inform the Customer of the outcome of the complaint within that timeframe. This notification will be sent to the Customer electronically.

In the event of a price reduction or withdrawal from the contract, the Seller shall transfer the amount due within 14 days from the date of acceptance of the complaint by transfer to the account indicated by the Customer.

Complaints are not possible in the case of product properties resulting from its nature, in particular differences in color shades resulting from the settings of the monitor or screen of the Customer's device and the natural properties of artistic materials.

Art materials are specialized products whose final effect depends on the work technique, substrate, medium, and individual user preferences. A subjective assessment of the artistic effect does not constitute grounds for product complaints.

Complaints are not possible in the case of consumable products such as markers, felt-tip pens, inks, pens or other products with a limited service life if the loss of their properties is a result of natural wear and tear or improper use.

 

§ 11 Personal data protection and privacy policy

 

The Seller, i.e. Szał dla plastyków Spółka z ograniczoną odpowiedzialnością, with its registered office in Nowa Wieś Szlachecka, at ul. Lisiecka 1 (32-060 Nowa Wieś Szlachecka), is the controller of the Customers’ personal data.

Personal data is processed for the purpose of fulfilling orders and providing services electronically in accordance with the Privacy Policy. Providing personal data is voluntary, but necessary for order fulfillment, the provision of services electronically, and the Customer's ability to make purchases in the online store www.szaldlaplastykow.pl .

The Customer's personal data may be made available by the Online Store to other recipients of personal data, including in particular:

● mBank SA with its registered office in Warsaw, ul. Prosta 18, 00-850 Warsaw, registered by the District Court for the capital city of Warsaw, 13th Commercial Division of the National Court Register under KRS number 0000025237, to the extent necessary to execute payments;

● SZAŁ SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office in Kraków, ul. Warszawska 1, 31-155 Kraków, Poland, entered into the register of entrepreneurs maintained by the District Court for Kraków-Śródmieście in Kraków, 12th Commercial Division of the National Court Register under the KRS number 0001143284, Tax Identification Number (NIP) 6762683118 in the scope of order fulfillment, handling vouchers and gift cards, handling loyalty programs and marketing activities conducted as part of the operations of Szał dla Plastyków stores;

● Entities supporting the Administrator, e.g. courier companies;

● Public authorities pursuant to legal provisions.

Detailed rules for the processing of personal data and the rights of data subjects are specified in the Privacy Policy available on the Store's website (link to the privacy policy) .

The Seller is entitled to disclose personal data administered by it only to bodies authorized under applicable law.

The Seller uses cookies, which contain information necessary for the proper functioning of the Store, in particular the authorization process and remembering personal settings. § 12 Newsletter

 

The Customer may consent to receiving commercial information, including commercial information electronically, by selecting the appropriate option in the registration form or later in the "Your account" tab, then "Your personal data" and "Subscribe to the newsletter." If such consent is granted, the Customer will receive the online store's newsletter (www.szaldlaplastykow.pl) at the email address they provide, as well as other commercial information sent by the Seller on their own behalf or on behalf of third parties.

The Customer may unsubscribe from the Newsletter at any time by unchecking the appropriate box in the tab: Your account, then: Your personal data and Subscribe to the newsletter.

 

§ 13 Technical requirements and prohibition of unlawful activities

 

To properly use the Online Store, the Customer is required to use an application for browsing the Internet (a browser) and an email account. The Customer is responsible for providing the above-mentioned device and the necessary software. It is recommended to use the latest, updated versions of browsers. Minimum requirements are: Chrome version 34 or higher, Firefox version 28 or higher, Opera version 12 or higher, Safari version 5 or higher. The Seller recommends that Customers use the following device security measures simultaneously:

installing reputable antivirus and anti-spam software;

installing a firewall;

ongoing updating of the operating system supporting the end device.

The Customer is obligated to refrain from engaging in any illegal activity or conduct that could prevent or hinder other Customers from properly using the Online Store. In particular, the Customer is obligated to:

not to use the Store for the purpose of conducting illegal activities or in a way that may constitute a violation of the law and make it difficult for other Customers to use it,

securing and protecting confidential data such as access passwords,

not attempting to violate the Seller's system resources to which the Customer is not authorized,

compliance with the statutory prohibition on the Customer providing illegal content.

 

§ 14 Extrajudicial methods of resolving disputes

Consumers have the option of using out-of-court complaint and redress procedures. In particular, consumers have the option of:

● turning to the permanent consumer arbitration court at the provincial inspector of the Trade Inspection, 

using mediation conducted by the provincial inspector of the Trade Inspection,

● obtaining assistance from the district or municipal consumer ombudsman. 

§ 15 Final provisions

 

The Seller reserves the right to change these Regulations for important legal or organizational reasons, in particular in the event of:

● changes in legal regulations,

● changes to payment or delivery methods,

● changes to the scope of services offered or store functionality,

● the need to adapt the Regulations to the decisions of administrative bodies or court rulings.

Amendments to the Terms and Conditions do not violate any rights acquired by Customers prior to their introduction. The amended Terms and Conditions are effective from the time they are published on the Online Store website.

These Regulations are available in electronic version at www.szaldlaplastykow.pl

Information about the Seller will be confirmed by the Seller in writing each time, no later than upon delivery of the Goods to the Customer.

In matters not regulated in the Regulations, the provisions of Polish law, including the Civil Code, shall apply.

Any disputes between the Seller and the Consumer will be resolved by a competent common court in accordance with the law.
